You’re Still Not Members of Rivers House of Assembly, Appeal Court Tells 27 Decamped Lawmakers

The Court of Appeal in Abuja, on Friday, refused to set aside a judgment ordering the removal of Martins Chike Amaewhule and 26 others as members of the Rivers State House of Assembly.

Justice Charles Wali of the Rivers State High Court, Port Harcourt, on May 30 declared the seats of the 27 lawmakers who dumped the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) in October last year vacant.

The judge, who delivered the ruling in a suit filed by the Speaker of the Assembly, Victor Oko Jumbo, and two others, also restrained Amaewhule from parading himself as Speaker of the Assembly.

Dissatisfied with the verdict, the aggrieved lawmakers approached the appellate court to set it aside.

However, at a virtual hearing of the matter on Friday, a three-member panel of the appellate court declared that the reversal of the lower court ruling would amount to pre-judging the appeal currently before it.

The panel, thereafter, fixed June 20 for the hearing of the appeal filed by the lawmakers in their quest to regain their seats in the Assembly.

Kano Emirate Tussle: Court Orders Reversal to Statusquo, Sets Aside Law That Dethroned Bayero

A Federal High Court in Kano has set aside the procedures taken by the Kano State government to repeal the Kano Emirate Council Repeal Law 2024.

The law, recently passed by the Kano State House of Assembly on May 23, was immediately signed into law by Governor Abba Yusuf and was used to dethrone Emir Aminu Ado Bayero and reappoint Muhammadu Sanusi II as the 16th Emir of Kano.

Also, it was used to reverse the creation of four emirates—Bichi, Rano, Karaye, and Gaya, established by the former governor, Abdullahi Ganduje, in 2020.

However, the Sarkin Dawaki Babba, Aminu Danagundi, who was represented by Chikaosolu Ojukwu (SAN), challenged the legality of the new law and asked the court to declare the law null and void.

After hearing the motion last Friday, the presiding judge, Justice Abdullahi Liman, adjourned the ruling till this Thursday.

Counsel to the State House of Assembly and its Speaker, Eyitayo Fatogun (SAN), informed the court of a notice of appeal filed at the Court of Appeal, seeking a stay proceedings.

However, Justice Liman noted that there was no evidence that the appeal had been entered nor any formal application for a stay filed.

In his ruling on Thursday, Justice Liman set aside the action of the Kano government, ordering parties to maintain the status quo.

The judge held that the defendants were aware of the interim order granted by the court but chose to ignore it and went ahead with the implementation of the law.

Justice Liman, therefore, ruled that he would assume his coercive powers to enforce compliance with his order.

Court Denies Suspended DCP Abba Kyari Bail

Justice Emeka Nwite of the Abuja Federal High Court has denied suspended Deputy Commissioner of Police, Abba Kyari, bail.

In his ruling, the judge held that Kyari’s bail is at the discretion of the court in line with section 161 (2) of the Administration of Criminal Justice Act.

The judge ruled that Kyari had not shown any evidence to warrant the court granting him bail.

On May 22, the judge had granted the former boss of the Intelligence Response Team, IRT, temporary two-week bail to bury his mother.

However, the two weeks were extended by a week upon an application filed by Mr. Kyari for an extension of the bail.

On June 1, Kyari perfected the bail conditions and was released the same day.

At today’s proceedings, Justice Emeka Nwite refused to extend his earlier order but granted accelerated hearing in the case.

Kyari was detained following his arrest on February 14, 2022, by the National Drug Law Enforcement Agency for alleged involvement with an international drug cartel.

He, along with four members of the Police Intelligence Response Team—Sunday Ubia, Bawa James, Simon Agirigba, and John Nuhu—was arraigned on March 7, 2022.

Two suspected drug traffickers, Chibunna Umeibe and Emeka Ezenwanne, who were arrested at Akanu Ibiam International Airport in Enugu, were also charged.

While Kyari and the IRT members pleaded not guilty, Umeibe and Ezenwanne pleaded guilty and were convicted.

Police Recruitment: Sack IGP Egbetokun Now, PSC Union Tells Tinubu

The Joint Union Congress of the Police Service Commission has called for the removal of Inspector General of Police Kayode Egbetokun, accusing him of misrepresenting facts about the recently concluded recruitment exercise.

The police and the commission’s union had been at odds over the recent recruitment exercise.

On Saturday, the police alleged that the process was marred by corruption and other irregularities. Meanwhile, the PSC accused the police of attempting to hijack the process.

Addressing journalists on Wednesday, the Chairman of the union, Adoyi Adoyi, noted that the action of the IG was capable of causing chaos which he said was against his profession.

He said, “We begin this press conference with a clarion call on the President and Commander in Chief of the Federal Republic of Nigeria, Bola Tinubu to immediately relieve the IGP, Kayode Egbetokun of his appointment as IGP. Our concern comes from the fact that a public officer who misleads the President is causing confusion in the country and may lead to chaos which is antithetical to his duty as a police officer.

“His attitude has become only a replica of the Biblical Haman who in deceiving his principal wanted to wipe out an entire nation but for the tiny intervention of God. So we call on the president to responsibly relieve him of his duties for the following reasons.”

Adoyi also alleged that some elements within the police attempted to smuggle over 1000 names into the recruitment list.

He said, “We have been furnished with reliable information indicating that elements within the Police Force attempted to smuggle over 1,000 names into the recruitment list. This manipulation was a grave breach of the recruitment process and a calculated attempt to undermine the credibility of the entire exercise.

Adoyi described the allegations levelled by the IG against the commission as false, unfounded and spurious.

He said, “The allegations of fraud and several unwholesome acts levelled against the Police Service Commission and its staff are, to say the least, unfounded, spurious, speculative and most irresponsible, especially by the way the allegations were thrown into the public space even before official channel of communication for dealing with such a matter was explored.”
